Civil Litigation
If you are involved in a legal dispute with another party or parties, or anticipate becoming involved in one, you can contact our Winnipeg office for expert legal advice.
Civil litigation is an area of law involving a dispute between parties where one or both sides may be seeking damages, or to require a party to take (or stop taking) specific actions.
In criminal law cases, the burden of proof is “beyond a reasonable doubt”, whereas in litigation the burden is instead “the balance of probabilities”. Simply put, the balance of probabilities refers to whether something is more likely than not to be true, even if the degree of certainty is only slight, like 51%.
Common examples of litigation claims include, but are not limited to:
- Contract disputes
- Construction liens
- Commercial landlord and tenant disputes
- Litigation of estate matters
- Debt collection
- Negligence claims
- Medical malpractice
- Defense of litigation claims
