A will is a document that describes how a person would like their estate (all money, property, and debts owned by an individual) to be managed when that person becomes deceased. 

There are a number of challenges that can arise if someone passes away without a will:

  • Your estate may be distributed in a way that results in certain family members getting more or less than you would have wanted
  • Possessions that have sentimental value may end up with the wrong family member
  • A family member that you do not trust with such a significant responsibility may be appointed as the Executor/Executrix
  • There may be family strain as various members argue over who should be appointed to manage the estate in the absence of a will designating such a person

Probate

A probate is the process of determine whether or not a will is valid, and what the terms of the will actually mean. 

HEALTH CARE DIRECTIVES

A healthcare directive describes treatments you do or do not wish to receive in the event that you become unable to make such decisions yourself. You can appoint a health care proxy that has the authority to make these decisions when you are unable to do so yourself.

Powers of Attorney

This document allows you to give another person the authority to make decisions and act on your behalf under certain conditions. A general power of attorney grants the ability to do all things that you yourself can lawfully do. Alternatively, a limited power of attorney will grant only specific powers and authority.
